Today’s sitting of the Seym (28 July 2023) included consideration of Senate’s resolution to reject the Act to amend the VAT Act and certain other legislation (Amending Act), which introduces mandatory e-invoicing and the National E-Invoicing System (KSeF). The resolution was dismissed by the Sejm on a slim majority. This means that the Amending Act is now fully enacted as it was transmitted to the Senate. The new law is now waiting for signature of the Polish President to become effective.

The closing stages of the legislative process on the mandatory e-invoicing law coincided with the publication of the most recent e-invoice schema (FA2). After public consultations, this schema will be run in the test environment as of 1 September and will become available in the production environment as of 2 September (schema FA1 will be replaced with FA2).

This is the best time to start implementing the new e-invoicing regulations and requirements so that technical implementation, testing, and training for accounting and finance functions are all completed before the new law enters into force on 1 July 2024.
